Terms and Conditions

Utilizing Event Images/Videos

By utilizing our services, you, the client, grants Memory Booth LLC the absolute and irrevocable right to use photographs and videos taken of the photo booth area and equipment during the event, but expressly excluding any images taken by the photo booth or the polaroid booth during the event, for promotional, advertising, and commercial purposes across all media.

Require Deposit

A 50% deposit or full payment is required to secure your event date. Cancellations made 14 days or more before the event will receive a full refund, including the deposit. Cancellations made within 14 days of the event will result in the forfeiture of the deposit or 50% of the full payment.

Bad Weather and Unforeseen Circumstances

In the event of inclement weather or other unforeseen circumstances that make the event unsafe or impossible, Memory Booth LLC reserves the right to reschedule the service, if possible. Both parties will work together in good faith to find a mutually agreeable date. If rescheduling is not possible, a full refund, including the deposit, will be provided.

Damages and Liability

Memory Booth LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the photo booth services. In no event shall Memory Booth LLC's aggregate liability for all claims relating to the services exceed the total amount paid to them by the client.

Power and Spacing

The client is responsible for providing adequate space for the photo booth and ensuring a reliable power source is available within a reasonable distance. Memory Booth LLC is not liable for any performance issues or damages caused by inadequate space or power supply.

Damages to Memory Booth LLC Property

The client agrees to be responsible for any damage, loss, or theft of Memory Booth LLC's equipment caused by the negligence or misconduct of the client, their guests, or any attendees at the event. The client agrees to reimburse Memory Booth LLC for the full cost of repair or replacement.

Stable Internet Connection

Memory Booth LLC relies on a stable internet connection for digital sharing features. If a suitable connection is not provided by the client or venue, Memory Booth LLC can provide a Wi-Fi connection for an additional fee, but is not responsible for any delays or failures in delivering those digital services.

Attendant Safety and Harrassment

Memory Booth LLC is committed to providing a safe working environment for our staff. We reserve the right to immediately cease operations and remove our equipment if the attendant feels threatened, unsafe, or is subjected to any form of harassment by the client, venue staff, or event guests. In such cases, the client will not be eligible for a refund.

Setup and Breakdown

Memory Booth LLC will arrive approximately 2 hours prior to the scheduled start time to set up the equipment and will require time after the event for breakdown. This setup and breakdown time is included in our service and is not counted against your active rental hours. The client is responsible for ensuring the venue allows access to our staff during these setup and breakdown windows.

Payment Schedule & Final Balance

A deposit is required upon booking to secure your event date. The remaining balance must be paid in full no later than 7 calendar days prior to the event date [or prior to setup on the day of the event]. If the final balance is not paid by the due date, Memory Booth LLC reserves the right to cancel the booking, withhold services, and retain the initial deposit in accordance with our cancellation policy.

Idle Time & Delays

If the event schedule is delayed through no fault of Memory Booth LLC, or if the client requests that the booth pause operations during the contracted rental period (e.g., during speeches, dinner, or official proceedings), these non-operational hours are considered "Idle Time." Idle Time counts toward the contracted service period.

Child Supervision & Equipment Protection

For the safety of guests and the protection of equipment, children under the age of 10 must be accompanied and supervised by a responsible adult while using the photo booth, props, and surrounding equipment area. Memory Booth LLC attendants are on-site to operate the booth and assist guests, but are not responsible for supervising children.

Any legal action, suit, or proceeding arising out of or relating to these services shall be instituted exclusively in the state or federal courts located in Pulaski County, Missouri.
